Description: DTA provided
a third party independent and objective review and analysis
of the $3.55 Million claim for “Damages and Demand for Mediation
and Arbitration” submitted by General Contractor. The damages
were allegedly due to delays caused by the County and designer
during the construction of the Justice Center. The claim
was based on multiple issues that allegedly caused the general
contractor and subcontractors to be delayed in completing
the facility. DTA reviewed all project correspondence, requests
for information, submittal logs, baseline schedule and monthly
updates related to the claim. DTA reviewed entitlement to
each of the issues and analyzed the schedules to determine
how each issue effected the schedule. DTA submitted a final
report to the County indicating the findings and recommendations
on resolution of the claim. DTA is anticipated to provide
assistance during Mediation and Arbitration proceedings.
The $43 million, 160,000 sf, 8 story center, which opened
in February 2006, houses the Reno Municipal Court and the
Washoe County District Attorney.

Description: Dispute resolution
services on an as-needed basis. In the course of a construction
project, disputes may arise resulting in the filing of a construction
claim against the Veterans Affairs (VA) by a contractor. In
defense of a potential claim, DTA was assigned a task order
to assist the VA to resolve and defend such claims when they
occurred. One such dispute/claim involved the $17 million
Renovation and Addition to the VA Medical Center in Miami,
FL, which included the construction and renovation of new
examination rooms, x-ray rooms and offices. DTA was brought
in to work with VA’s counsel to review and analyze the claim,
and provide a strategy and recommendations for resolution.
Services rendered included the review of contract documents
along with plans, specifications, correspondence, daily reports
and change orders. Utilizing the Primavera Software product
(P3), DTA reviewed the contractor’s schedules and performed
an independent impact analysis of the claim along with a revised
as-built schedule. Upon completion of the analysis, DTA submitted
a written report to the VA. Serving as an expert witness,
DTA then assisted the VA to obtain a favorable judgment, whereby
the claim was disallowed.
